Workers Comp Retaliation
No employer shall discharge, threaten to discharge, intimidate, or coerce any employee by reason of such employee's valid claim for compensation or attempt to claim compensation under the Workers' Compensation Law.
An employee who has been the victim of worker’s compensation retaliation initiated by their employer may bring a lawsuit within 4 years of the alleged retaliatory conduct. If he or she prevails in a lawsuit against the employer, they are entitled to recover lost wages and damages for emotional distress.
